These Terms & Conditions ("Terms") govern your access to and use of the Web Guru Awards website, platform and services operated by Web Guru Awards Ltd. ("Web Guru Awards", "WGA", "we", "us" or "our").

By accessing, browsing, submitting a website, creating an account, voting, purchasing a service, advertising, posting a job, or otherwise using the Web Guru Awards platform ("Site" or "Platform"), you agree to these Terms.

If you do not agree with these Terms, you must not use the relevant Site or Services.

These Terms should be read together with our Privacy Policy, Cookie Policy, Legal & Compliance page and any additional rules or terms applicable to a particular Service, award or promotion.

Acceptance of These Terms

By using the Platform, you confirm that:

  • You have read and understood these Terms
  • You agree to comply with these Terms
  • You will comply with all applicable laws and regulations
  • Any information you provide is accurate and not misleading
  • If you are acting for a company, agency or organisation, you have authority to do so

If you use a particular Service that has additional terms, those terms also apply. Where specific Service terms conflict with these general Terms, the specific terms will apply to the extent of the conflict.

Eligibility

You must be legally capable of entering into these Terms under the laws applicable to you.

Where permitted by applicable law, users under 18 may use appropriate areas of the Platform with the involvement and permission of a parent or legal guardian.

Certain Services may have additional eligibility requirements.

We may restrict access where we reasonably believe that a user does not meet applicable eligibility requirements or has violated these Terms.

Website Submissions

You may submit websites for consideration through the submission process available on the Platform. A submission may require information such as:

  • Website title
  • Website URL
  • Company, agency or organisation
  • Website owner or contact information
  • Email address
  • Country
  • Website description
  • Category
  • Tags
  • Colour selections
  • Social media links
  • Website screenshots or images
  • Other visual assets
  • Other information requested in the submission form

You are responsible for ensuring that all information supplied is accurate, complete and current.

Submitting a website does not guarantee:

  • Acceptance
  • Nominee status
  • Guru of the Day recognition
  • Guru of the Month recognition
  • Guru of the Year recognition
  • A certificate
  • An award badge
  • A particular ranking
  • A particular number of votes
  • Any particular amount of exposure or commercial benefit

We may review, reject, request clarification regarding, modify the presentation of, or remove a submission where reasonably necessary.

Eligible Websites

We aim to recognise creative and high-quality websites from around the world. The Platform may accept websites including, but not limited to:

  • Agency websites
  • Brand websites
  • Business websites
  • Portfolio websites
  • Freelancer websites
  • Developer websites
  • Designer websites
  • E-commerce websites
  • Educational websites
  • Entertainment websites
  • Technology websites
  • Informational websites
  • Other creative digital experiences

We may reject or remove websites that contain or promote unlawful, fraudulent, obscene, exploitative or otherwise prohibited content.

Websites involving pornography, unlawful activity, illegal services or prohibited gambling/betting activities may be rejected. This list is not exhaustive.

Submission Plans and Services

WGA may offer free and paid submission options or other Service plans.

The features, submission limits, review options, priority services, certificates, badges and other benefits associated with a particular plan will be displayed on the applicable submission or pricing page.

Where a paid plan is available, the applicable price and included benefits will be presented before purchase.

We may introduce new plans, modify existing plans or discontinue plans, subject to applicable law.

Purchasing a plan does not guarantee an award, nomination, ranking, number of votes, traffic or commercial result.

Submission Review

Submitted websites may be reviewed by WGA or individuals appointed by WGA. We may consider factors including:

  • Design quality
  • Originality
  • Creativity
  • User interface
  • User experience
  • Ease of use
  • Content and copywriting
  • Functionality
  • Technology
  • Innovation
  • Overall quality
  • Other factors relevant to the award

The current award criteria include unique and impressive design, intuitive and easy-to-use experiences, engaging and relevant copywriting, and the use of technology and innovation.

We may update evaluation criteria from time to time.

Nominee Status

Following evaluation, a website may be selected as a nominee. Nominee status represents recognition and inclusion in the Web Guru Awards showcase. Nomination does not guarantee an award.

Nominee websites may be displayed publicly on the Platform, including through nominee galleries and individual website detail pages.

Nominees may receive exposure through the Web Guru Awards Platform, but WGA does not guarantee any particular number of:

  • Views
  • Votes
  • Visitors
  • Leads
  • Customers
  • Social interactions
  • Commercial opportunities

Guru of the Day

Web Guru Awards may select one website as Guru of the Day ("GOTD") for an applicable award day.

A GOTD winner may be showcased on the Web Guru Awards homepage and other areas of the Platform.

The current award structure states that daily winners become eligible for consideration for the monthly award. Selection remains subject to WGA's evaluation and award rules.

Guru of the Month

Guru of the Month ("GOTM") recognises outstanding work from the applicable monthly award cycle.

GOTD winners may become nominees for the applicable monthly award. WGA reviews qualifying daily winners from the relevant period and selects the monthly winner.

The applicable award process may change between award cycles.

Guru of the Year

Guru of the Year ("GOTY") is the annual award recognising outstanding work from the applicable annual award cycle.

The current award structure includes monthly winners from the applicable annual period as GOTY nominees. The annual winner is selected according to the evaluation and award rules applicable to that award cycle.

Award Evaluation and Voting

Where public voting is part of an award, public voting contributes to the final result. The current WGA award criteria provide for:

  • 40% — Public Votes
  • 60% — Creativity and Innovation / Website Evaluation

Accordingly, receiving the highest number of votes alone does not necessarily determine the winner.

WGA may use expert review, internal evaluation and public voting as part of its award process. The applicable evaluation criteria and weighting may be changed for future award cycles.

Where changes materially affect an active competition, we will communicate the applicable rules as reasonably appropriate.

Public Voting

Where voting is available, eligible users may vote for nominated websites through the Platform. Voting may be subject to technical, account, geographic, frequency or other restrictions.

You must not:

  • Use bots
  • Use automated voting systems
  • Create fraudulent accounts
  • Use scripts or software to generate votes
  • Purchase or sell votes
  • Exchange votes for improper consideration
  • Submit duplicate or fraudulent votes
  • Manipulate voting systems
  • Circumvent voting limits
  • Exploit technical vulnerabilities
  • Interfere with another user's voting
  • Coordinate fraudulent voting activity
  • Otherwise attempt to unfairly influence an award

We may monitor voting activity for security, fraud and abuse prevention.

Where we reasonably believe votes have been generated through prohibited or fraudulent activity, we may:

  • Remove votes
  • Ignore votes
  • Suspend voting
  • Disqualify an entry
  • Restrict an account
  • Suspend or terminate access
  • Take other measures necessary to protect the integrity of the award

Leaderboards and Rankings

The Platform may display voting totals, views, rankings, popularity information or other statistics. Such information may change as the Platform receives new activity or as fraudulent or invalid activity is identified.

Displayed rankings are not necessarily a final award determination.

WGA may correct, adjust or remove rankings, votes, views or other statistics where we identify errors, manipulation, technical issues or other circumstances affecting accuracy.

Awards, Certificates and Badges

Winners may receive certificates and/or award badges where applicable. WGA may provide separate recognition for:

  • Nominee
  • Guru of the Day
  • Guru of the Month
  • Guru of the Year

Certificates may be provided digitally or through another method specified by WGA. Award badges may be used by recipients to identify the relevant recognised website, subject to these Terms.

You must not:

  • Alter an award certificate in a misleading way
  • Claim an award that was not granted
  • Claim a higher award than the one received
  • Use a nominee badge as a winner badge
  • Transfer an award to an unrelated website
  • Use WGA branding to imply an endorsement or partnership that does not exist
  • Continue representing an award as valid after it has been withdrawn

WGA may revoke an award, certificate or badge where it was obtained through fraud, manipulation, false information or a material violation of these Terms.

Public Showcase and Award Records

WGA is a public awards and showcase platform. If your website becomes a nominee or winner, information relating to the submission may be publicly displayed. This may include:

  • Website name
  • Website URL
  • Designer or developer name
  • Agency or company name
  • Country
  • Website description
  • Category
  • Tags
  • Website screenshots
  • Logo
  • Award status
  • Award date
  • Voting information
  • Views or other statistics
  • Public profile information
  • Award history

Public award listings may be retained as part of WGA's historical archive and showcase.

Intellectual Property Ownership

You retain ownership of the intellectual property in your submitted website, designs, images, text, logos, trademarks and other materials.

Submitting material to WGA does not transfer ownership of that material to Web Guru Awards Ltd.

The current WGA website likewise states that submitted designs and websites remain the sole property of their owners.

You are responsible for ensuring that you have all rights and permissions necessary to submit the material.

Licence to Web Guru Awards

By submitting content to WGA, you grant Web Guru Awards a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, publish, resize, crop, format, adapt and distribute the submitted material to the extent reasonably necessary to:

  • Operate the Platform
  • Display nominee and winner pages
  • Showcase submitted websites
  • Promote Web Guru Awards
  • Promote award winners
  • Publish galleries
  • Publish editorial or award-related content
  • Display award badges
  • Promote WGA through social media
  • Produce marketing materials
  • Maintain historical award records

This licence does not transfer ownership of your intellectual property.

You may request removal of submitted promotional material where appropriate, subject to legitimate legal, operational, archival and record-keeping requirements.

Your Responsibility for Submitted Content

You represent and warrant that:

  • You own the submitted material or have permission to submit it
  • You have authority to grant the licence described in these Terms
  • The submission does not infringe another person's intellectual property rights
  • The submission does not unlawfully use another person's personal information
  • The submission does not contain unlawful material
  • The information supplied to WGA is not knowingly false or misleading
  • Your submission complies with applicable laws

You remain responsible for disputes arising from content you submit.

Removal of Submitted Content

We may remove or restrict a submission where we reasonably believe:

  • It violates these Terms
  • It infringes third-party rights
  • It contains unlawful or prohibited content
  • The website is no longer accessible
  • The information is materially misleading
  • Fraud or manipulation has occurred
  • A security issue exists
  • A legal complaint has been received
  • Removal is otherwise reasonably necessary to protect the Platform or its users

Removal of a submission does not automatically create an entitlement to a refund unless required by applicable law or the applicable purchase terms.

User Accounts

Certain Platform features may require an account. Where you create an account, you agree to provide accurate and current information.

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • Securing your account
  • All activity conducted through your account
  • Updating inaccurate account information
  • Not sharing your account in a manner that violates these Terms

You must notify us if you believe your account has been compromised.

Acceptable Use

You must use the Platform lawfully and responsibly. You must not:

  • Attempt unauthorised access
  • Circumvent security measures
  • Introduce malware
  • Disrupt Platform infrastructure
  • Conduct denial-of-service attacks
  • Scrape or harvest data in a manner prohibited by law or our stated restrictions
  • Reverse engineer the Platform except where legally permitted
  • Interfere with another user's account
  • Impersonate another person or organisation
  • Submit fraudulent information
  • Manipulate votes or rankings
  • Send spam
  • Harass or threaten users or WGA personnel
  • Use the Platform for unlawful activities
  • Promote prohibited services
  • Upload harmful or unlawful content
  • Attempt to exploit vulnerabilities without authorisation

Prohibited Content

WGA may reject or remove content involving:

  • Illegal activity
  • Fraud
  • Malware
  • Phishing
  • Piracy
  • Copyright infringement
  • Child sexual exploitation or abuse
  • Non-consensual sexual content
  • Serious threats or harassment
  • Unlawful gambling or betting
  • Content facilitating criminal activity
  • Material that creates significant security risks
  • Other material prohibited by applicable law

This list is not exhaustive.

Payments and Paid Services

Where a Service requires payment, the applicable price and Service terms will be displayed before purchase.

Payment processing may be provided by third-party payment providers, including Stripe. Payment providers may process payment and transaction information according to their own terms and privacy policies.

WGA may receive information such as:

  • Transaction reference
  • Payment status
  • Amount
  • Currency
  • Customer information
  • Other information necessary to provide the Service

We do not intend to store full payment card details on our own systems.

Refunds and Cancellations

Refund and cancellation rights depend on the Service purchased, the applicable purchase terms and applicable law.

Where a refund policy applies, it will be made available before or at the time of purchase.

Nothing in these Terms removes or restricts mandatory consumer rights that cannot legally be excluded.

If you believe you have been incorrectly charged, contact us promptly with relevant transaction information.

Advertising Services

WGA may offer paid advertising and featured placement services. Advertising may appear in locations including:

  • Homepage
  • Internal pages
  • Award pages
  • Editorial pages
  • Other Platform areas

Advertising prices, placement, duration and specifications will be displayed in the applicable advertising service information.

Advertisers are responsible for ensuring that their advertising materials are:

  • Accurate
  • Lawful
  • Non-misleading
  • Properly authorised
  • Non-infringing

WGA may reject or remove advertisements that violate these Terms or applicable law.

Payment for advertising does not guarantee:

  • A particular number of impressions
  • Clicks
  • Leads
  • Sales
  • Customers
  • Award recognition
  • Any particular commercial result

Jobs and Recruitment Services

Where WGA provides job listings or recruitment-related functionality, employers are responsible for their job advertisements and recruitment practices.

Employers must ensure that job postings are accurate and comply with applicable employment and anti-discrimination laws.

WGA does not guarantee:

  • Employer legitimacy
  • Candidate suitability
  • Employment
  • Interviews
  • Salary
  • Job placement
  • Any particular recruitment outcome

Users should independently verify employers and opportunities before providing sensitive information.

Newsletter and Communications

By providing your email address, you may receive communications relating to:

  • Your submission
  • Your account
  • Awards
  • Voting
  • Certificates
  • Service updates
  • Platform announcements
  • Newsletter content
  • Marketing communications where permitted by law

You may unsubscribe from non-essential marketing communications using the unsubscribe mechanism provided. Essential transactional or service communications may continue where necessary.

The Platform may contain links to third-party websites and services. These may include:

  • Submitted websites
  • Social media platforms
  • Payment providers
  • Advertisers
  • Employers

Third-party websites and services operate under their own terms and privacy policies. WGA is not responsible for third-party content, availability, security or privacy practices except where liability cannot legally be excluded.

Award Changes, Suspension or Cancellation

WGA may modify, suspend or cancel an award, voting period, category or competition where reasonably necessary because of:

  • Technical problems
  • Fraud or manipulation
  • Security issues
  • Insufficient eligible entries
  • Legal requirements
  • Operational circumstances
  • Force majeure
  • Other circumstances affecting the integrity or operation of the award

Where an award is suspended or cancelled, WGA will take reasonable steps to communicate material changes where appropriate.

Disqualification

WGA may disqualify a submission, nominee, voter, account or winner where we reasonably determine that:

  • These Terms have been violated
  • False or misleading information was supplied
  • Voting was manipulated
  • Fraud occurred
  • Third-party rights were infringed
  • Prohibited content was submitted
  • Security was compromised
  • Continued participation could undermine the integrity of the Platform or award

Where appropriate, disqualification may occur without prior notice.

Suspension and Termination

We may suspend or terminate access to the Platform or an account where permitted by law. Grounds may include:

  • Material breach of these Terms
  • Fraud
  • Abuse
  • Security concerns
  • Illegal activity
  • Voting manipulation
  • Intellectual property infringement
  • Other conduct that materially harms the Platform or its users

You may stop using the Platform at any time. Termination does not affect provisions that by their nature should continue after termination.

Intellectual Property of Web Guru Awards

The Web Guru Awards name, branding, logos, website design, original text, graphics, software and other WGA materials are owned by or licensed to Web Guru Awards Ltd. or its licensors.

You must not reproduce, modify, distribute, sell or commercially exploit WGA intellectual property without appropriate permission.

Nothing in these Terms grants you ownership of WGA intellectual property.

Limitation of Liability

To the maximum extent permitted by applicable law, Web Guru Awards Ltd., its directors, officers, employees, contractors and agents will not be liable for indirect, incidental, special or consequential losses arising from your use of the Platform. This may include loss of:

  • Profits
  • Revenue
  • Business
  • Data
  • Goodwill
  • Reputation
  • Opportunities
  • Expected benefits

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or other mandatory legal liability.

No Guarantee of Commercial Results

Awards and Platform exposure may provide recognition and visibility, but WGA does not guarantee any particular commercial outcome. We do not guarantee that participation will result in:

  • Increased traffic
  • Increased sales
  • More customers
  • More leads
  • Increased search rankings
  • Increased social-media followers
  • Business opportunities
  • Any particular return on investment

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Web Guru Awards Ltd., its directors, officers, employees, contractors and agents from claims, liabilities, losses, damages and reasonable expenses arising from:

  • Your violation of these Terms
  • Your unlawful use of the Platform
  • Your submitted content
  • Your infringement of third-party rights
  • Fraudulent activity associated with your account
  • Your violation of applicable law

Changes to the Platform

We may add, remove or modify:

Where legally required, we will provide appropriate notice of material changes.

Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the Last Updated date.

Where required by law, material changes will be communicated through appropriate means.

Your continued use of the Platform after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

If you do not agree with the updated Terms, you should stop using the affected Services.

Governing Law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protection rights that apply to you.

Subject to applicable mandatory rights, the courts of England and Wales will have jurisdiction over disputes arising from or relating to these Terms or your use of the Platform.

Nothing in this clause removes mandatory rights you may have under the laws of your country of residence.

Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be modified or removed only to the extent necessary. The remaining provisions will continue in effect.

No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

  • Applicable award rules
  • Applicable submission rules
  • Applicable payment or refund terms
  • Any other Service-specific terms expressly incorporated into the Platform

constitute the agreement governing your use of the relevant Web Guru Awards Services.
